Anonymous Aggregated Information.  Our policy does not limit our ability to aggregate anonymous user demographic data or to target educational, product, sponsorship or advertising information to specific users based on affiliations or geographic locations. Such targeted industry information is one aspect of our site that the user should find valuable. 

Third-Party Service Providers.  We may also partner with third parties (“Service Providers”) to provide specific services and products, facilitate and provide the website on our behalf, perform website-related services and/or assist us in analyzing how the website is used.  We will share Personal Information as necessary so that those services may be provided.  These Service Providers have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use your Personal Information for any other purpose.

If you subscribe to our newsletter, we will ask for a contact name, company name, phone number and email address. Of course you may opt-out of our newsletters at any time. 

Tell a Friend.  If you choose to refer a friend to our website, we will ask for the friend's name and email address. We will send a onetime email inviting them to the website. We store that information for the purpose of sending that email. The friend may contact us at any time to request removal of this information from our database. 

Required Legal Disclosure of Information.  In some instances we may be required by law to disclose Personal Information if required to do so by law or in response to valid requests by public authorities, such as a court or a government agency.  We may also disclose your personal Information in the good faith belief that such action is necessary to to comply with a legal obligation, to protect and defend our rights or property, to prevent or investigate possible wrongdoing in connection with the website, to protect the personal safety of users of the website or the public, and/or to protect against legal liability.   

Security Practices 

We have taken significant administrative and technical actions to attempt to protect against unauthorized access to or disclosure of Personal Information—both online and offline. Within our offices, we have established operating procedures which restrict employee access to sensitive information. Credit card information that you provide to us is used for billing purposes only. We also use third party programmers or other outsourcers to assist us with our business. However, these companies do not retain, store or use personally identifiable information for any secondary purpose beyond the service we are outsourcing. 

You are responsible for the use of your passwords. We strongly suggest that you be careful in the use and storage of your password and that you do not provide it to others. We also suggest that you log out of our client area and close your browser after each work session to prohibit unauthorized access by others. 

User Access to Edit or Delete Your Information 

You may inform HR Performance Solutions at any time of changes to Your Personal Information (e.g., name or address) or if you no longer desire our services. Registered users may access and edit their Personal Information in their user profiles. The website does not address anyone under the age of 18 (“children”).  We do not knowingly collect personally identifiable information from anyone under the age of 18. Exercising Access, Data Portability, Deletion and Correction Rights. To exercise the access, data portability, deletion and correction rights described above, please submit a verifiable consumer request to us by either:  

You may only make a verifiable consumer request for access or data portability no more than twice within a 12-month period.   

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.  

When we receive a verifiable request from your authorized agent, which is any person or legal entity registered with the California Secretary of State that you have authorized to act on your behalf, we will require:   

  • Submission of a written document signed by you with your permission for the authorized agent to submit a verifiable request on your behalf and require the authorized agent to verify its own identity to us; or  
  • Require your authorized agent to furnish a copy of a power of attorney pursuant to California Probate Code sections 4000 to 4465 and require the authorized agent to verify its own identity to us.  

We will deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf and cannot verify their own identity to us.  

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will provide the notice by mail to account holders and non-account holders by mail.   

 Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. If applicable, the response will also explain the reasons we cannot comply with a request. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request.  

The Right to Opt-Out of the Sale of Personal Information.  You have the right to opt-out of the sale of your Personal Information. To exercise this right, please complete the Notice of Right to Opt-Out.  

 Right of Non-Discrimination.  We will not discriminate against you for exercising any of your rights in this Privacy Policy and under applicable laws. Unless permitted by law, we will not:   

  • Deny you goods or services  
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties  
  • Provide you a different level or quality of goods or services  
  • Suggest that you may receive a different price for goods or services or a different level or quality of goods or services
